Grim Hats Terms & Conditions
(Including SMS/Text Messaging)

These Terms & Conditions (“Terms”) apply to your use of the Grim Hats website and services and to any purchases you make from Grim Hats (“we,” “us,” “our”). By accessing our website, placing an order, or opting in to receive marketing communications (email and/or text), you agree to these Terms.
1) Eligibility
You must be at least 18 years old (or the age of majority where you live) to place an order or opt in to marketing communications.
2) Products & Availability
We may change product offerings, pricing, and availability at any time. Product photos are for reference; colors and placement may vary slightly due to screen settings and production processes.
3) Custom Orders, Payment in Advance, Artwork Fees, Set-Up Fees & Proof Approval
Many items we sell are custom-made or made-to-order.
Payment in Advance (Required):
All custom orders must be paid in full in advance before production begins. Production will not start until payment is received and cleared.
Artwork Fee (Minimum $25):
Custom orders may require design time, file cleanup, vectorizing, resizing, or other production-ready preparation. An artwork fee may be applied at Grim Hats’ discretion, with a minimum artwork fee of $25.
Set-Up Fee for Custom Artwork Jobs ($50):
Custom artwork jobs may also require a set-up fee of $50 (for example: preparing files for print/embroidery/laser, test layouts, and production setup). This fee may apply in addition to any artwork fee.
Non-Refundable Fees Once Work Starts:
Artwork fees and set-up fees are non-refundable once work begins.
Proofs/Mockups & Approval (Custom / Non-Retail Designs):
If the order is not a retail design sold by Grim Hats, the customer must provide written approval (email/text) of the proof/mockup before production begins. The customer has one (1) working day to respond with any changes. If no changes are requested within one (1) working day, the proof may be treated as approved and production may begin.
Changes After Approval:
Changes after approval are handled at Grim Hats’ discretion and may require additional fees and/or additional production time.
4) Pricing & Payments
All prices are listed in U.S. dollars unless stated otherwise. Payment is due at checkout unless otherwise agreed in writing. We may correct pricing errors and cancel orders affected by obvious mistakes.
5) Order Changes & Cancellations
Orders can only be changed or canceled before production begins. Once production starts, cancellations and changes are not guaranteed and may not be possible.
6) Shipping & Delivery
Processing times vary by product and order volume. Delivery dates are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or events outside our control. To the extent permitted by law, risk of loss transfers to the customer when the package is handed to the shipping carrier.
7) Returns, Exchanges & Refunds
Return/Exchange Eligibility (Non-Custom Items):
Returns/exchanges may be accepted for eligible non-custom items if the return shipment is postmarked within seven (7) days of delivery.
To be eligible, items must be unworn, unused, unwashed, and in like-new condition, with any original tags/packaging included. Items showing signs of wear are not eligible, including (but not limited to) odors, stains, pet hair, deodorant marks, washing, or damage.
Custom / Personalized Items:
Custom or personalized items are final sale and not eligible for return or exchange, unless the item arrives defective or we made an error.
Custom/personalized includes items made with customer-provided artwork, custom text, custom logos, or made-to-order production.
Defects / Wrong Item:
If your order arrives damaged, defective, or incorrect, you must contact us and/or initiate the return process so the return shipment is postmarked within seven (7) days of delivery. Please include your order number and clear photos so we can make it right.
Return Shipping:
Return shipping is paid by the customer unless Grim Hats made an error (wrong item, defect, or damage attributable to us). We recommend using a trackable shipping method. We are not responsible for lost return packages.
Original Shipping Charges:
Original shipping charges are non-refundable.
Inspection:
All returns are inspected upon arrival. If an item is not returned in the required condition, we may refuse the return/exchange.
8) Intellectual Property
All content on this website (including logos, designs, photos, graphics, and text) is owned by Grim Hats or used with permission and may not be copied, reproduced, or used without written consent.
9) Customer-Provided Content (Artwork/Logos)
If you submit artwork, logos, or designs, you represent that you own the rights or have permission to use them. You grant us permission to reproduce that content solely to produce your order. You agree to indemnify and hold us harmless from claims related to customer-provided content (including copyright or trademark disputes).
10) Prohibited Use
You agree not to misuse the website, attempt unauthorized access, interfere with site operations, or use the site for unlawful purposes.
11) Marketing Communications (Email)
If you sign up for our email list, you consent to receive marketing and transactional emails from Grim Hats (such as new product drops, promotions, and order updates). You can unsubscribe at any time using the link in any marketing email. Unsubscribing from marketing emails will not affect transactional messages related to your orders (e.g., receipts, shipping updates).
12) Text/SMS Messaging Terms
If you provide your phone number and opt in (for example, at checkout or through a signup form), you consent to receive text messages from Grim Hats, which may include marketing messages (promotions, product drops) and transactional messages (order or delivery updates).
Consent is not a condition of purchase.
Message frequency may vary.
Message and data rates may apply.
To opt out at any time, reply STOP. You may receive one final message confirming your opt-out.

Carriers are not liable for delayed or undelivered messages.
13) Disclaimer of Warranties
To the fullest extent permitted by law, the website and products are provided “as is” and “as available,” without warranties of any kind.
14) Limitation of Liability
To the fullest extent permitted by law, Grim Hats will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.
15) Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.
16) Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with a new effective date.
